Data we do NOT collect by default
• No account data — no sign-in or user accounts.
• No third-party analytics/ads SDKs.
• No payment info — Apple processes all payments; we never receive your card/banking details.

Data we process to operate the App
• Audio you record — stored locally on your device. We do not access your audio unless you share it (e.g., export/email).
• Subscription status — we receive non-personal signals from Apple’s StoreKit to verify an active entitlement.
• Diagnostics (optional) — Apple may provide crash/performance data to help improve stability. We do not use this for tracking.

If you contact support
When you email robert@robertpatricktiernan.com, we receive your email address and message content. We use this only to respond and to keep a record of the issue. You can ask us to delete past support emails at any time.

Permissions
• Microphone — required to record audio.
• File access / share sheet — only when you export/share.

Data retention
• Local audio stays on your device until you delete it.
• Support emails are kept until your request is resolved, or sooner upon your request.
• Diagnostics are retained per Apple’s policies.

Your rights
Depending on your region, you may request access, correction, deletion, or restriction of personal info you’ve provided (e.g., support emails). Contact robert@robertpatricktiernan.com.

Children
The App is not directed to children under 13. Please do not send us children’s personal information.

Security
We use Apple’s platform security features and standard safeguards. No method is 100% secure.

International users
By using the App, you understand your information may be processed in the United States.

Terms of Use

1. Overview
These Terms of Use (“Terms”) govern your use of the Musician Memo app by Mercury Direct (developer: Robert Patrick Tiernan) (“we,” “us,” “our”). By using the app, you agree to these Terms.

2. Apple EULA
Your use of the app is also governed by Apple’s Standard EULA: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
If these Terms conflict with Apple’s EULA, the EULA controls for App Store matters.

3. License
We grant you a personal, non-transferable license to use the app on Apple-branded devices you own or control, as permitted by the EULA.

4. Subscriptions & Billing
Musician Memo Premium is a monthly, auto-renewing subscription. Your Apple ID is charged at confirmation and at each renewal, unless you cancel at least 24 hours before the current period ends. Manage in Settings → [your name] → Subscriptions. Pricing varies by region; taxes may apply. Partial periods aren’t refunded.

5. Your Content
You retain all rights to audio you record. You are responsible for having the rights to any material you record or import and for complying with applicable laws.

6. Acceptable Use
Do not misuse the app (e.g., infringe, reverse-engineer, disrupt, or use it for unlawful purposes).

7. Intellectual Property
The app and its content (excluding your recordings) are owned by us and licensed to you. All rights reserved.

8. Disclaimers
THE APP IS PROVIDED “AS IS.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Audio quality may vary by device, environment, and accessories.

9. Limitation of Liability
To the extent permitted by law, our total liability for claims related to the app will not exceed the amount you paid for the subscription during the 12 months before the claim.

10. Indemnity
You agree to indemnify and hold us harmless from claims arising from your misuse of the app or violation of these Terms.

11. Termination
We may suspend or terminate access for violations of these Terms. You may stop using the app at any time.

12. Changes
We may update these Terms. Continued use after changes means you accept the revised Terms. The “Effective date” above will be updated when changes are made.

13. Governing Law
These Terms are governed by the laws of Iowa, USA, excluding its conflict-of-law rules.

How do I restore my subscription on a new device?
Open the paywall and tap Restore Purchases (uses your Apple ID).
